Levy called a last-minute hearing on Thursday morning to address the matter with state prosecutors and Kelly’s lawyer, asking if they felt it was now appropriate for him to ‘recuse’ himself from the case because of the incident.
“Unless he lets you out, I’ll get some mates to do stuff to him,” Jacob Kelly allegedly said to his wife during the call, the court heard on Thursday.
He then allegedly followed up the call with a letter to the court stating that he was “extremely sorry” for his words, but later wrote that he wanted the letter withdrawn while he sought legal advice.
“The threat is, in fact, a threat to kill me,” the judge said.
The court heard Jacob Kelly also said to his wife that they still have “three more states to go” and that he would get her pregnant again.
The court previously heard that Kelly had a double mastectomy and told people she was suffering from breast cancer, which she was not.
She is due to be sentenced for the matter involving her children on Monday.
